What is Bail?

After being arrested and charged, a defendant is required to appear before a judge or magistrate in court. In many situations, the court date may be scheduled days or weeks into the future. Some defendants are eligible to be released from jail as they await the oncoming court appearance.

If the defendant is eligible, the court may set bail, which is the amount of money that must be paid to the court as a guarantee that the defendant will return to court as scheduled. This money is usually returned, should the defendant appear before the court at the scheduled time, but if the defendant does not show up to court as scheduled, the court keeps the money and issues a warrant for the defendant's arrest.

What is a Bail Bond?

A bail bond is an agreement for a bail bond agent to pay bail for the release of a defendant in exchange for a fee and the promise that the agent will return to court as scheduled. The bail bond agent serves as a surety and commits to paying the full bail amount to the court if the defendant does not appear as scheduled.

If a defendant does not have the financial resources to pay the amount of money the court asks for in order to release the defendant, a friend or loved one of the defendant may choose to sign a bail bond, agreeing to pay the bail bond agent's fee. The bail bond agent will then pay the entire bail amount to set the defendant free, expecting to receive the bail money back from the court, along with the agreed-upon fee.
